Employee injured in fall from ladder while painting

At 10:25 a.m. on April 7, 2003, Employee #1, a painter, sustained multiple fractures to both of his wrists, a head injury, a herniated disc in his neck, and a torn meniscus in the knee as a result of falling off of a ladder and striking the eyebrow upon which he was working. The personal fall arrest system worn by Employee #1, an Ultrasafe Inc. Full Body Harnesses, Model 96305N, with Ultrasafe Inc. Ultra-Tube Shock-Absorbing Lanyards, 1 inch by 6 inches, Model UT-96516, was not rigged such that Employee #1's free fall distance was not more than four feet. Employee #1 was working on top of an eyebrow that was 14 feet above the ground. Employee #1 had set the rope grab to his height, approximately 5 feet 10 inches above the eyebrow, and had clipped into it. He then proceeded to climb up the 8-foot ladder. Employee #1 stated that he was at the highest level he was supposed to go, which is 5 feet 9 inches as measured on the ladder. This placed the anchor end of the lanyard at the employee's feet. Additionally, since the lanyard was 6 feet long, this makes the employee's free fall distance approximately 11 feet 9 inches. When the ladder buckled and Employee #1 fell, he struck the eyebrow with his legs, knees, hands, and head. Employee #1 was transported to LA County/USC Medical Center where he was admitted for treatment.
