Employee injured when struck by fork of fork lift

At 6:30 a.m. on August 21, 2000, Employee #1 was driving a pallet jack on Aisle Number One of the cooler room, heading northbound. The company, Shapiro Gilman Shandler, Inc., is engaged in farm produce warehousing. Their main operation is loading and unloading boxes containing various produce items using fork lifts and pallet jacks in the warehouse. Employee #1 was a loader who had worked for the company for three months at the time of the accident. Employee #1 was looking for a potato box in order to set up an order. A coworker was using a fork lift to move pallets stacked with produce boxes to the storage racks to clear the aisles in the cooler room. As Employee #1 was passing the first corridor that intersected with Aisle Number One, his right leg was hit by the fork of the fork lift which was operated by the coworker. The coworker was leaving the cooler room when his fork lift collided with Employee #1. Neither of the employees sounded their horns at cross aisles, and the coworker was driving his fork lift with the forks raised about three feet above the ground. Employee #1 was transported to White Memorial Hospital where he was diagnosed with a right tibia fracture. He was hospitalized for three days.
