Carpenter's thumb amputated by saw

At 11:05 a.m. on November 20, 2003, Employee #1, a carpenter with Bomel Construction Co., Inc., was working at a construction site of a large office building under construction in Santa Monica, CA. He was cutting a 4 by 4 piece of wood, using a 7.5 inch worm drive Skillsaw brand hand held saw. When the saw wouldn't cut through the stock with one pass, he made one cut and then as he turned over the piece to make the second cut he noticed that his thumb was missing. Employee #1 says that he didn't feel the saw cut his thumb, and that the guard was on and functioning. The safety director for the general contractor examined the saw right after the accident and found it to be in the condition as shipped by the manufacturer. The cut was so clean that the hospital was able to reattach it and it is still functioning.
