Employee injured when fingertip amputated by bag machine

At 10:00 a.m. on July 3, 2003, Employee #1, a maintenance and repair worker employed by the Friedman Bag Company in Los Angeles, was working on the Automatex Bag Maker Machine Number 5 in the Flexo Department of the work site. The employer manufactures textile and polyethylene bags for packaging various products. The Automatex machine performs all types of cutting, folding, sewing and stacking operations for making polyethylene and polypropylene bags. These bags are used for packaging of products such as fruits and vegetables. Employee #1 was adjusting an air valve, which controls the movable part referred to as "Transfer 2". The Transfer 2 is located at the end of Conveyor 1 and is a grabbing bar that goes up and down and moves horizontally back and forth. The Transfer 2 bar grabs the material at the end of Conveyor 1 and transfers it to Conveyor 2. At both conveyors different parts of the bag are sewed. An air valve is used to make adjustments of the Transfer 2 part. Employee #1 was making an adjustment on the machine because it was twisting the bags. According to Employee #1, the air valve control knob was tight and while putting pressure on the knob his hand slipped and simultaneously the Transfer 2 part moved horizontally towards Employee #1's hand resulting in the amputation of the tip of the fifth digit of the right hand. The machine was not stopped and the power source deenergized or disengaged during the adjusting operations. In addition, the Transfer 2 part was not mechanically blocked or locked out to prevent inadvertent movement during cleaning, servicing or adjusting operations. The employer did not provide and require the use of extension tools by employees during such operations. Employee #1 sustained an amputation of the tip of the fifth digit of the right hand and was transported to Stacey Medical Clinic where treatment was rendered.
