Homebuilding employee cuts finger using a radial arm saw

At approximately 10:00 a.m. on November 12, 2002, Employee #1, a lumber department service clerk at a retail homebuilding store, was cutting lumber for a customer with a 16 inch radial arm saw. The saw is a 5 horsepower Original Radial Arm Saw (serial number 09440006) and is guarded on its sides with an articulated chain-like device. Employee #1 cut two thicknesses of 2 in by 8 in pieces of wood. The blade guard jammed. Employee #1 shook the guard a little to release it. As he did, his hand touched the blade, cutting it. Employee #1 was hospitalized with a deep cut to the bottom of the knuckle on his left index finger, which required a skin graft, and cut the upper joint of the thumb of the same hand. Employee #1 was released from the hospital in less than 24 hours but required subsequent surgery. The employer failed to adequately train the employee and failed to lockout the equipment.
