Employee's fingers amputated when caught by clamp

At approximately 3:10 p.m. on July 12, 1995, Employee #1, whose employer fabricates auto headers and exhaust systems, was using a mandrel tube bender to operate a 13 in. long by 1 1/2 in diameter, 10-10 carbon steel exhaust pipe. To close the mandrel, he pushed the button control at his back with his right hand. Employee #1 then inserted the pipe inside the clamp with his left hand while the machine was cycling. His fingers were caught as the clamp block closed onto the pipe. His left index finger was crushed and his left middle finger was amputated. According to the employer, Employee #1 was properly trained and had three months of experience; however, he was operating the tube bender while his fingers were inside the clamp area, violating the company's rules and regulations. No malfunctions in the equipment and procedures were found during the investigation.
