Employee's foot amputated when forklift overturns

At approximately 6:30 p.m. on February 27, 1995, Employee #1 was parking a forklift on an even surface when it began to overturn. As he noticed the rolling motion of the forklift, he jumped off and fell onto the blacktop. The mast back guard struck Employee #1's left leg, amputating his foot just above the ankle. The employer was cited for a serious violation of T8CCR 3664(a)(1), for lack of training in forklift operations, and because Employee #1 was neither designated nor authorized to drive the forklift.
