Employee Fractures Foot in Fall from Ladder

At approximately 2:30 p.m. on July 16, 2004, Employee #1 was performing a fogging procedure on a chimney and was working at approximately 13 ft in elevation above the ground using a 24-ft extension ladder. A coworker was next to Employee #1 while he was doing the work. The ladder was not secured and tied-off and the base of it was set up at approximately 11 ft away from the chimney, which was at approximately a 45-degree angle and fully extended. Employee #1 did not receive job safety training and instruction on safely working with ladders was not provided. The ladder was displaced from its position at the base. Employee #1 fell approximately 13 ft and hit the ground. Employee #1 suffered an open fracture of the right foot and was hospitalized for two days for surgery and treatment.
