Employee injured when pinned between forklift and rack

Employee #1 was operating a Cat #9 stand-up forklift, model NRR35P, serial #2GL00839. He was replacing a pallet on rack 999 at the east end of Aisle 36 in the back warehouse when he backed into rack 952. Employee #1 became pinned between the forklift and the cross member of the rack.; he suffered a crushed pelvis. Employee #1 was not officially working at the time of the accident. During his time off, he purchased products from the employer, repackaged it off site, and then sold it. Employee #1 had not made his presence known before using the forklift.
