Employee's leg fractured when caught under forklift

At approximately 3:20 a.m. on December 10, 1998, Employee #1, of Con-Way Express, was using a forklift to unload a truck at a loading dock. He had just removed two pallets stacked one atop the other, and stepped off his vehicle to read the labels on the pallets. Employee #1 put his left foot back and was leaning down when another forklift passed close by and caught his foot under its wheel. Employee #1 suffered a compound fracture of his lower left leg; he was hospitalized for seven days.
