Employee's leg injured when trench caves in

At approximately 2:00 p.m. on September 28, 1998, Employee #1, of Ford Construction Company, Inc., was at the bottom of an 8 ft deep trench where a pipe had been broken by a backhoe. He was shoveling around the pipe when the side wall caved in and a large rock pinned his left foot and leg to the bottom of the excavation. Employee #1 was helped from the trench by a coworker and treated by the local fire department paramedics, who placed a splint on his leg. He refused to be transported by ambulance and instead was taken by company truck to Barton Memorial Hospital, where he was treated for torn ligaments and a dislocated knee. The trench had no shoring or other form of protective system. At the time of the accident, there was approximately 1 ft of sewer water at the bottom of the excavation, along with loamy sand and rock.
