Employee Gets Shot in the Shoulder with Nail Gun

On September 28, 2010, Employee #1 and Employee #2 of Vinyl Designs Inc. were installing siding on the gable of a single story apartment complex. Employee #2 slipped and started to fall. Employee #2 was carrying a nail gun in his hand when he slipped. Employee #2 had his finger on the trigger of the nail gun when he slipped on the slopped metal roof. Employee #2 struck Employee #1 on the back with the nail gun. A 2 3/4-inch nail was driven into Employee #1's left shoulder blade.
