Employee injured by falling tree section

On December 26, 2001, Employee #1 with Paradise Tree Service was removing an 80-ft-tall tree at a private residence in Paradise, CA. His coworker was in the tree removing sections of the trunk, and they had established a verbal communication system to allow Employee #1 to retrieve each section as they were cut. When the trunk was approximately 30-ft-tall, the two employees mis-communicated, and Employee #1 was struck by a trunk section approximately 18-in. long, 24-in. diameter, and weighing 80 lbs. He suffered a compound fracture of his right leg and was hospitalized for 4 days.
