Employee injured when struck by excavator

Employee #1 was working as a superintendent for a construction contractor that drills/digs foundations and footings for bridges and other structures. The employee was walking on the bridge deck checking the work site. He walked over to the edge of the bridge and stepped on the bridge curbing and positioned himself between the bridge guard rail and an excavator that was drilling a hole for a foundation support. The excavator swung around and pinned the employee between the guard rail and counter weight of the excavator. Employee #1 received a fractured pelvis. The employee walked into an area of the counter weight swing radius known to be a hazardous area. The employee stated that he was not paying attention to where he positioned himself.
