Employee's leg fractured when backed over by forklift

At approximately 7:25 p.m. on June 19, 2000, Employee #1, a garbage paper sorter for the National Recycling Corporation, entered the baling area to help clean up cardboard and other debris. He began to bend over and pick up paper near the baler conveyor hopper, while a coworker used a forklift to push cardboard into the hopper. After pushing his load forward, the coworker checked both sides of the forklift and began to back up. He heard a yell and immediately stopped his vehicle, which had struck Employee #1 on his left side. He suffered a fractured left leg and was transported by ambulance to Kaiser Hospital in Oakland, CA, where he underwent emergency surgery. At the time of the accident, Employee #1 had approximately 6 months of experience with the company.
