Employee suffers fractures in all terrain forklift roll-over

Employee #1 was preparing an area for the construction of a campground rest room. He was using a GEHL rough terrain all-wheel-drive forklift (capacity 8,000 lb) to move a 600 lb bundle of #4 rebar (30 ft lengths) from the front of the building site to a location behind the site. He had backed down the road approximately 100 ft with the rebar and begun his turn when he stopped to ask the foreman where he wanted the rebar. Employee #1 then backed in a circle to keep the load uphill. He stopped again on the side of the 4 degree slope. At this time the forklift tipped over onto its left side and bounced. The side door frame sheared off, and Employee #1 fell from the cab. When the forklift landed again, it landed on Employee #1, breaking his leg and pelvis and causing internal injuries. Employee #1 had had the forks too high for the side slope he stopped on. Even with a relatively light load, the combination of the height of the forks and the load made the forklift unstable and caused it to tip over. The forklift had ROPS and a seat belt but Employee #1 was not wearing his seat belt. If Employee #1 had been wearing the installed seat belt, he would not have been ejected from the vehicle. Employee #1 said that when he felt the machine tipping, he unhooked his seat belt and attempted to jump from the forklift. There is a warning sign in the forklift that says to hang on and remain in the cab in the event of tipping.
