Employee killed when struck by falling vibratory hammer

At approximately 9:34 a.m. on June 7, 1997, Employee #1 was moving hydraulic lines on a pile driver for a sandblasting pit under construction. A Link Belt crane, model #LS98, with a 60 ft boom, was being used to move pilings. A corner piling (to be used later) was moved out of the way so that the crane could be repositioned. The crane operator set down the corner piling with his whip line; meanwhile, a vibratory hammer was hanging at the top of the crane's boom, at a height of about 75 ft. The crane operator began to move the crane to the northwest, swinging the boom in the same direction, when the foot brake disengaged, releasing the vibratory hammer. The hammer fell on Employee #1, severing his legs at the knees and causing other injuries that resulted in his death. The right (main) brake on the crane showed excessive wear and was found to be defective.
