Employee's back punctured in fall onto claw hammer

At approximately 9:30 a.m. on June 22, 2000, Employee #1, a carpenter for AMS Staff Personnel, was framing homes at a new development site. He was laying 2 by 4 stud sole plates on the floor, then marking them for the framer to nail. Employee #1 was stepping forward to write on a sole plate when it slipped out from under his shoe and he and the 2 by 4 fell 9 ft 6 in. to the ground. He landed on his back on the soft ground, and the claw of the hammer that was hanging on his tool belt punctured the right side of his back above his waist. Employee #1 was transported to Sharp Hospital, where the injury was cleaned and stitched. There were no witnesses to the accident. Employee #1 was trained and the supervisor was in the immediate vicinity. The employer failed to ensure that fall protection was worn by all employees whose work exposed them to falling more than a 7 ft 6 in. The employer was cited for a serious, accident-related violation of T8CCR 1670(a).
