Employee breaks leg in 16 foot fall off a ladder

The employer operates a ranch and farm supply retail store and was constructing a metal building. Employee #1 was hired to help because of his knowledge of metal building construction. On his second day on the job, they were connecting the last rafter to a column. Employee #1 was on an aluminum extension ladder about 16 feet above the ground. A coworker was on the other side of the ladder in a man basket on a forklift. The forklift operator, who was the employer, moved in closer in order to reposition the man basket. A wheel on the forklift slipped and the basket hit the column. Employee #1 fell off the ladder, suffering eight breaks in his left leg, which was caught in the ladder on the way down. The ladder was secured between the two flanges on the column and did not fall. The forklift operator has been operating forklifts for about 12 years and has had training and given training to his employees.
