Employee's thumb amputated by Skil saw

Employee #1, of Rancho Framing, Inc., was using a Black & Decker Skilsaw, with a 7 1/4 in. blade and 2 1/2 HP motor, to notch a 2 by 2 for fire blocks. He was in the bathroom area on the second floor of a house under construction. The saw hit a nail or knot, jumped back, and cut through 15 percent of his left thumb. The cause of the accident is unknown. There were no witnesses. Employee #1 states the saw guard was not tied up.
