Employee's hand struck and injured by tire mounting tool

At about 11:00 a.m. on September 27, 1994, Employee #1 was mounting a 14 inch tire, using a Coats tire machine, when he was hit by a mount/demount tool that was thrown off the tire machine. Employee #1 was hit in the left hand at the upper joint of the middle finger, breaking it and cutting nerves and tendons. The employer took him to Serria Vista Hospital where he stayed until September 29, 1994. Employee #1 said that the tool had come off several times before the accident. There was no serial number or sign on the machine, but a similar machine had a warning sign on it to check the oil level if there were a jerky movement, and warned that the mount/demount tool could be thrown off and injure the operator. The employer did not have a copy of the tire machine operating instructions, which indicated that the oil should be filled to within 1 inch of the top. When inspected, the oil level was found to be 5 inches from the top; there was about 1 in. of oil in the tank. A citation was issued for failure to keep the tire machine in safe operating condition. Also, a citation was issued for failure to report the accident.
