Employee injured when portable circular saw kicks back

At approximately 2:25 p.m. on January 10, 1996, Employee #1 was using a portable Skil power saw, model 77, with a 7 1/4 in. diameter blade to cut a 1 1/2 in. by 5 1/2 in. notch out of a 14 in. by 6 in. by 2 in. board. He was holding the board with his left hand and the circular saw in his right hand when the saw kicked back. Employee #1 sustained a 6 in. cut to his thigh. He was transported to the hospital, where he was treated and released approximately 20 hours later. Employee #1 and his supervisor both said that the guard was operable, and the supervisor said he saw it right after the accident. The employer was cited for failing to give instructions on how to make small cuts in an safe manner. The small pieces of wood should have been secured before they were cut with a power saw.
