Employee injured when he slips on curb

The employer operates a three-island gasoline station, with three gas pumps at each island. The pump islands were about 6 in. high by 4 1/2 ft wide and 50 ft long. At approximately 8:00 a.m. on September 26, 1995, a witness saw Employee #1 step up on the second island to change a customer's money. His right foot slipped off the curb and he slipped forward, hitting his forehead against a 1 in. electrical pipe and falling face down next to a washbucket. The employee was taken to Mercy Hospital, where he was treated for injuries to his forehead, neck, and back. The employer states that the employee was properly trained with six years of experience in stepping on and off the curb. There were no malfunctions of equipment or procedures. No accident-related violation was discovered. However, the employer was found in violation of T8CCR 342(a), and a citation was issued with penalty.
