Employee struck in the eye by broken nail

At approximately 10:25 a.m. on April 15, 1994, Employee #1, a trained carpenter with three years of experience, was hammering a 3 in. long galvanized nail into a 2 in. by 8 in. board above the exterior corner of a three car garage. He was not wearing eye protection and when the nail broke apart, a fragment flew into his right eye. He was taken to Pomerado Hospital by his foreman for treatment. According to Employee #1, the employer failed to provide eye protection and never enforced the use of eye protection. The employer was found in violation of California safety and health standards and a serious citation was issued with a penalty.
