Employee injured in fall while framing house

At 9:45 a.m. on October 4, Employee #1, a carpenter for T and M Framing, was rough framing on the second floor of one of nine tract homes under construction in a development. He was making a typical exterior stud wall, nailing the bottom plate onto 2 by 4 wall studs. He was bent over and standing on the stud while driving in nails when his foot slipped. He stumbled forward, fell 9 ft 10 in. and landed on some scrap lumber. Employee #1 fractured six ribs on his left side and suffered head trauma. He was taken to Palomar Medical Center, where he was hospitalized for four days. Employee #1 stated while still in the hospital that he remembered nothing about the accident. The employer was cited for a serious violation of T8CCR 1513(a), scrap lumber not cleared from the work area; and a serious violation of T8CCR 1670(a), no fall protection provided for work at a height over 7 ft 6 in. At the time of the accident, Employee #1 was working alone without direct supervision. His working partner was on the ground and out of the immediate area.
