Employee fractures leg while riding on forklift

At approximately 2:30 p.m. on April 22, 1994, Employee #1, of Western Industrial Management, Inc., was in the reserve inventory area of STS, the site employer. He was riding on a pallet that was mounted on the forks of a Nissan-30 forklift. An employee of another temporary employer was operating the forklift. When Employee #1 turned toward the forklift operator to see which way he was going to turn the forklift, his left foot missed the pallet and hit the floor. Employee #1 lost his balance and his left leg was run over by the forklift's right front tire. He was transported to Loma Linda University Medical Center. The forklift operator had not been trained in the safe operation of a forklift. Employee #1 was not a trained operator either and should have been given instructions not to ride the forklift. The employer was issued a citation for a violation of T8CCR 3664(a).
