Employee injured in fall from truck bed

At approximately 11:30 a.m. on April 27, 1995, Employee #1, a truck driver, delivered a parcel load to a Lucky Store in Arroyo Grande. He was securing the load on the 47 foot trailer using a load lock bar, which goes across the back of the remaining load and is attached to the walls of the enclosed trailer to prevent the load from moving back. A spring-loaded clip located on one end of the bar, is between two side bars and if the side bars are bent, the clip will not work. Employee #1 was standing on the back end of the trailer about 4 1/2 ft above a concrete slab. He was hitting the bar end against the side of the trailer wall to bend it open so that the clip would work. The bar came against him, causing him to lose his balance and fall to the concrete slab. Suffering bruises and back pain, Employee #1 was taken to a medical center for treatment. A citation was issued that the bar had not been maintained safely and that Employee #1 had not been trained in the only way to correct a bent side bar.
