Employee injured when pinned against back of delivery truck

At approximately 10:35 p.m. on September 16, 1995, Employee #1, a UPS driver, was standing in the rear of his trailer doing paperwork. At the same time, the driver of another UPS package truck, #119360, was backing out of the parking lot of the feeder yard. She ran into the rear of Employee #1's trailer, pinning him against the rear of it. He sustained serious fractures of his right leg and pelvis, and lacerations to his hand and forearm. Causal factors in this accident include the driver's failure to check her right rearview mirror and her failure to check all around her vehicle immediately prior to backing up. The employer has an ongoing and effective safety program, and was found to be in compliance. The UPS driver at fault had worked for the company since January 1993, and was properly trained and experienced; she was terminated following the accident.
