Employee's finger amputated by saw blade

At approximately 10:45 p.m. on May 16, 1995, Employee #1, of Sundance Spas, was operating the right saw of a double mitre saw. He operated the foot pedal to activate the clamp to hold the stock, a 2 in. by 2 in. piece of hemlock fir stained black. With his left hand, he reached up over the left saw blade to engage the actuator, which brings down the right saw blade and guard. At the same time, he rotated his body at the hips. His right index finger, which was being held at waist level, contacted the saw blade and was amputated to the nail bed. The finger was surgically amputated at the distal joint. The saw blade was properly guarded; Employee #1's inadvertent body movement caused this amputation.
