Employee injured in fall when scissor lift overturns

At approximately 3:30 p.m. on December 19, 1994, Employee #1 and three coworkers, of the Jilson Construction Group, were installing and repairing drywall at a site in Pasadena, CA. Employee #1 was using a scissor lift to patch holes at the east side of the building. He lowered the lift and drove to the north side, stopped, and then raised the lift to its full height. The scissor lift started to tip over and Employee #1 fell with it, approximately 20 ft, to the floor. He fractured his left ankle and was transported by paramedics to Huntington Memorial Hospital, where he remained for about 2 1/2 days. On December 20, 1995, the general contractor notified the DOSH/West Covina District Office of the accident. On December 23, 1994, the Division performed an accident investigation and facility inspection at the job site. The employer was cited for a regulatory violation of T8CCR 392(a), for failure to report a serious industrial injury; a serious violation of T8CCR 1632(a), for a floor opening that was not guarded by a standard; and a serious violation of T8CCR 1512(b), for failure to make a thorough survey of the condition of the job site. Several other general and serious violations were found unrelated to this accident, and the employer was cited accordingly.
