Employee slips and falls on muddied surface

Employee #1, the foreman, was lifting a 4 by 12 board, when he lost his footing, fell, and was hit by the board. The surface that he had been standing on had become wet and muddied when water being pumped from the construction holes had passed through the berm barrier to the working surfaces. There were no established witnesses, although there were about 5 other workers in the area at the time. It was established that a housekeeping violation was related to the accident.
