Investigation Summary
On November 9, 1995, Employee #1, a foreman, and a coworker, an equipment operator, both of Bud's Equipment, were checking a high dipstick level on a Caterpillar 966-D articulated wheeled loader at an oil spill remediation site. They were draining small quantities of crankcase oil, looking for possible water contamination. An oil company representative drove up to the site and Employee #1 told the operator to move the loader. Employee #1 was closing the service doors on the engine enclosure and standing on the loader counterweight when the operator started the loader, put the bucket in float position, and backed up. Employee #1 fell parallel to the rear wheel and was struck. He suffered the avulsion of skin from his legs and feet and an amputated toe. A serious safety violation, T8CCR 3314(a), was cited.
