Employee's fingers amputated by power shear

On April 27, 1995, Employee #1 was operating a press brake when the employer pulled him off the machine to do a job on a shear power press. Employee #1 stated that he had operated power shears at a previous job, but this was his first time operating the power shear at Pro Craft Industries. The employer performed setup and demonstrated to Employee #1 how to place his fingers between the hold downs to secure a piece while it was being cut. The employer did not install a guard and, in fact, demonstrated to Employee #1 how to produce a part with the guard removed. The employer later stated that he leaves it up to his employees to install the guard. He watched Employee #1 produce a part and then left. Employee #1's hand was later caught in the unguarded machine and his fingers amputated by knives.
