Employee's ankle broken in fall from stepladder

Employee #1 is an inventory clerk in the maintenance department of a sawmill. The mill was in a scheduled shutdown and Employee #1 was assigned by her immediate supervisor to paint identification numbers on machinery and equipment. When she came to the #1 ram kicker at the debarker, which was elevated, she needed a ladder to properly apply the number. Employee #1 found a stepladder in the parts room, where the painter stores his gear. She set up the ladder and while she was climbing, the stepladder collapsed and she fell to the ground feet first, then landed on her back. Employee #1 suffered an open compound fracture of the right ankle. The stepladder was missing a spreader on the right side. The employer was cited for a general violation of T8CCR 3278(e)(1) for not properly maintaining the stepladder. The citation was general rather than serious because a 4 ft fall does not usually result in a serious injury.
