Employee's legs fractured by falling material

On October 30, 2000, Employee #1 was helping a co-worker restack and sort a crated box of copper using a forklift. The boxes of copper were 8 feet by 8 feet by 3-in. deep and were stacked approximately 4 feet off the ground on 4'x4' wooden boards. The Co-Worker was operating forklift to lift the boxes while Employee #1 was pulling out the boards. While pulling out one of the wooden boards the boxes became unstable and fell onto Employee #1 pinning him against the wall. Employee #1 was hospitalized.
