Employee injured when struck by falling objects

At approximately 12:15 a.m. on April 1, 2004, Employee #1 and coworkers were removing large cultured stones from rubber moulds and packing them in boxes. Near their work area stood a metal rack that measured 20-feet long by 12-feet high by 3.5-feet wide and contained partially filled boxes of product. While they were working, a forklift came to remove a box from the rack. Employee #1 and coworkers stood aside to allow forklift to maneuver. As the forklift removed a box from the top level of the rack it caught a box on the upright of the rack and pulled it over. The rack fell and dumped boxes in the vicinity of Employee #1 and his coworkers. All of the coworkers ran out of the way, but Employee #1 was hit by the rack and boxes of stone. Employee #1 was hospitalized and treated for a fractured left ankle, a ripped ear, which required 15 stitches to reattach, and a head injury that caused unconsciousness for a short time. Employee #1 was a temporary employee, supplied by a temporary employee agency.
