Employee killed when struck by falling tree

Employee #1 cut an oak tree and it fell to the ground. He cut another oak tree and it hit a small sugar maple and broke it. Both trees then lodged in a larger sugar maple. While Employee #1 was talking to a coworker, the small sugar maple dislodged and fell to the ground. Employee #1 decided to delimb and top the first oak tree that he felled, which was under the lodged oak tree. While he was topping the oak tree, the lodged oak fell and struck him. Employee #1 was killed.
