Carpenter injured in fall from house after slipping

Employee #1, a carpenter by trade for eleven years, had been assigned the job of working from the 2 by 4 top plate of a frame house, cutting tails from the roof joists. Because a ladder was not provided, Employee #1 accessed the 9 ft work high area by climbing the fire blocks of the stud walls. Once at elevation, he would stand on the 2 by 4 top plate and reach out to the tails of the roof joist to cut them where another worker had marked them. Employee #1 was using a 7 1/2 in. worm drive Skil saw. While leaning out from the 9 ft height, he reached with the saw to cut the 2 by 6 roof joist. Employee #1 slipped and fell to the cement porch, landing on his buttocks and banging his head. His leg, whipped from the movement of the fall, sustained a compound fracture that required surgery. Blood clots settling in his lungs required extended hospitalization. Employee #1 was never issued fall protection, a ladder, or a scaffold.
