Employee's leg injured when pinned by falling forklift mast

At approximately 9:37 a.m. on March 21, 1991, Employee #1, of Die-namic Fabrication, Inc., was emptying a tilting bin full of metal scrap from the forks of a propane-powered Yale forklift, #11481A. The tilting bin was not releasing from the lever handle. Employee #1 went on top of the forklift, put his left leg under the horizontal mast frame member, and pushed the release lever handle in an attempt to free it. The mast dropped, pinning Employee #1's leg between the mast frame and the central steel post of the hydraulic cylinder. He suffered fracture and multiple lacerations to his left leg and was hospitalized at San Antonio Community Hospital for 5 days. Employee #1 later stated that the mast of the forklift had been sticking in the top raised position and had not been repaired. The employer did not post or enforce operating rules and instructions for the company's forklifts.
