Employee's foot fractured when struck by forklift

Employee #1 had finished taking the last load of trash to the dumpster and was ready to get off work when she was stopped by the forklift operator and spoke with him. As their conversation was ending, she was backing away when another forklift came toward her with a load of copy paper. The second forklift driver sounded the horn several times, but Employee #1's attention was on the first forklift operator. She retreated another step and her right foot was caught under the second forklift's pallet. Employee #1's foot was broken.
