EMPLOYEE STRUCK BY A TREE BEING TOWED

EMPLOYEE #1 HAD SET A CHOKER AT THE ROOT BALL END ON A 42-FOOT LONG WINDFALL REDWOOD TREE. THE TRACTOR OPERATOR SAW EMPLOYEE #1 HEADING AWAY AND STARTED TO TAKE THE TURN IN. EMPLOYEE #1 STOPPED AND TURNED TO WATCH THE TRACTOR WHEN HE HEARD IT START TO PULL THE LOG IN. THE ROOT BALL HUNG UP AND THE TREE PIVOTED ON THE ROOT BALL, HITTING EMPLOYEE #1 ON THE RIGHT ANKLE AND CAUSING A COMPOUND FRACTURE. THE EMPLOYER WAS CITED FOR A SERIOUS VIOLATION OF 6328(F) FOR AN EMPLOYEE NOT STANDING CLEAR OF AN AREA AFFECTED BY THE TURN BREAKING OUT.
