Employee injured when struck by falling bread rack

At approximately 3:50 a.m. on May 1, 1991, Employee #1 and two coworkers found a transporter rack loaded with crushed wheat bread leaning approximately 20 degrees from vertical, resting against boxes of bread sticks. Earlier, the transport truck driver had pushed the loaded rack against the wheel stops at floor level with enough momentum that it tipped over against the stacked boxes. Because he was working alone, the driver did not attempt to right the 29 in. wide by 83 in. tall by 88 in. long, approximately 1,081 lb wheeled bread rack. When Employee #1 and his coworkers, all route truck drivers, tried to right the tipped rack, the bottom slid out and it fell over into a display rack. Employee #1was struck by the falling bread rack and suffered a broken left arm and dislocated shoulder.
