Employee's fingertip amputated by panel saw

On August 7, 1990, Employee #1, a saw operator with 7 months of experience with Home Depot, and 5 years of experience as a construction carpenter, was assigned to cut 107 4 ft by 8 ft plywood panels to size using a vertical panel saw. Each panel required 16 cuts. Employee #1 had been working since 7:00 a.m. when at approximately 1:30 p.m., a customer approached him from behind and startled him as he was cutting. Employee #1 gave the piece of plywood a hard push and turned toward the customer. His right hand struck against the moving saw blade, amputating the fleshy tip of his right little finger and the tip of his right ring finger, including the bone. The accident was apparently caused by the customer distracting Employee #1, and not by a violation of a safety order
