CONSTRUCTION EMPLOYEE KILLED WHEN HE FELL OFF A LADDER

EMPLOYEE #1 PLACED AN ALUMINUM LADDER AGAINST AN EXTERIOR APARTMENT BALCONY RAILING LOCATED APPROXIMATEELY 17 FEET ABOVE THE GROUND. HE ASCENDED THE LADDER AND ATTEMPTED TO STEP OVER THE BALCONY RAILING ONTO THE BALCONY. THE LADDER SLIPPED, CAUSING THE TO EMPLOYEE TO FALL TO THE GROUND. HE LANDED ON A 24 INCH HIGH CONCRETE RETAINING WALL AND SUFFERED MASSIVE HEAD INJURIES. THE EMPLOYEE ERRED IN PLACING AN ALUMINUM LADDER AGAINST AN ALUMINUM RAILING WITHOUT SECURING IT AGAINST DISPLACEMENT.
