Employee Is Asphyxiated While Checking Frozen Food

At approximately 8:00 p.m. on June 17, 2012, Employee #1, a partner in Food Business, Inc. Dba Germantown Cafe East, entered the freezer compartment to determine if dry ice prevented the loss of food in the freezer. Upon entering the freezer unit, the door closed behind Employee #1 and locked. The inside lock release mechanism was missing and had been for an extended period of time. The hole in which the release shaft had been was filled with putty to prevent loss of cold air. Power had been lost to the building complex on June 15, 2012. Between 400 and 500 pounds of dry ice was placed in the freezer between 11:30 p.m. on June 15, 2012 and 12:00 a.m. on June 16, 2013. Power was restored to the business in the afternoon of June 17, 2012. Employee #1 was discovered dead at approximately 9:00 a.m. on June 18, 2012.
