Investigation Summary
On April 19, 2012, Employee #1, a roofer with Robert Ochoa Dba Robert Ochoa, was removing old roofing shingles with a shovel when he lost his footing and fell thirteen and one half feet (13.5 feet) to the concrete driveway below and died. Employee #1 was wearing a full body harness with a rope grab attached to the front leg webbing of his harness, with a shock absorbing lanyard attached to a tempered anchor nailed near the peak of the roof, 23 feet above ground level. Employee #1's crew leader stated that the D-ring anchor pulled away from the rafter to which it was nailed. Photos taken shortly after the accident occurred revealed: excess lanyard; damaged sheathing on only one side of the roof peak; no nail holes on the other side as though driven into the sheathing only; and, the anchor was installed ninety degrees to the peak instead of over top per manufacturer's specifications. When force was exerted against the anchor, the nails were in tension, not in shear as designed. The nails were unavailable at the jobsite, however, other coworkers stated they pulled out of the sheathing and were not sheared off.
