Investigation Summary
At approximately 5:00 p.m. on May 18, 2012, Employee #1, a groundskeeper with Baldocchi & Sons, Inc. Dba Pacific Nurseries, was assisting in securing a big tree (about 14 ft high and 15 ft wide), which was being lifted on the forks of a forklift into a new planter-box. At the time, it was very windy. Employee #1 held the tree-stem with his left hand while he was standing in front of the forklift and accidentally placed his right foot on the mast-frame of the forklift. A coworker driving the forklift moved the forks outward, crushing Employee #1's right toe and foot between the fork and mast-frame. Employee #1 was hospitalized for more than 24 hours with a fractured big toe and dislocation of a little toe. The accident was caused both by Employee #1 placing his body part between the parts of an industrial truck where shearing and crushing hazards existed, and by there being a lack of employer knowledge.
