Investigation Summary
At approximately 10:30 a.m. on May 2, 2011, Employee #1, a temporary employee, was working at the secondary employer's facility. As a yardman/laborer, he was performing his regular duties of loading pipes onto a flatbed trailer. Four bundles of 8-inch and 10-inch Yelomine PVC (polyvinyl chloride) pipes were already loaded and were being chained to the trailer bed. An additional four stacks of 10-inch Yelomine PVC pipe bundles were raised again by the forklift, so that Employee #1 and a coworker could secure the bottom load first. As Employee #1 was waiting to finish securing the load on the side of the trailer, two of the additional stacks of bundles that were not yet chained and raised on the forklift blades fell and struck him. Employee #1 sustained fractures to his ribs and occipital lobe and a punctured lung. He also experienced back and head pain. Employee #1 was transported to Eden Medical Center in Castro Valley, where he was hospitalized for six days for the treatment of his injuries.
