Investigation Summary
On August 1, 2011, Employee #1 of Excelline Food Products LLC was assigned to the sanitation dept. One of his responsibilities was to empty 5 gallon drums of food waste into a dumpster. During Orientation, Employee #1 was told that no one is to operate a forklift in the company without first being authorized/certified. After three weeks working for the company, Employee #1, on his own, took possession of a forklift and lifted the 5 gallon drum off food waste on a pallet and drove it to the dumpster. Employee #1 raised forks about four to five feet and tilted the mast about 30 degree angle. Employee #1 got out of the cab and climbed up in between the mast and operators cab. His foot accidentally pushed the mast operating lever and the mast retracted to its upright positions pinning him between the mast and the top of the cab. Employee #1 died to injuries one week later
