Investigation Summary
At approximately 5:30 a.m., on September 2, 2011, Employee #1, a truck driver of DPI Specialty Foods sustained serious injuries (amputation of ring and middle fingers on right hand) while he was making a delivery to Stater Bros. That Store utilized a mechanical dock lever with metal plate (estimated weight of 200 lbs.) to unload trucks. Employee #1 positioned his truck's trailer at the store's dock. A pallet with materials was stored near the dock leveler. Employee #1 asked Employee #2 to move the pallet so he could unload. Employee#1 stated Employee #2 did not have time and told him to work around the pallet, because it was not blocking the whole dock leveler. Employee#1 attempted to operate the dock leveler, but one part of its metal plate hit the pallet and would not lock into place. Employee #1 went back to Employee #2. Employee #1 stated Employee #2 told him to push harder so the plate would lock into place. Employee #1 returned to the dock leveler. Employee #1 pushed harder on the metal bar as it moved downward toward the floor. The bar slid out of its holder. The two metal parts of the dock plate rose up, formed a right angle and stayed in position, but they did not lock into place. Employee #1 grabbed the metal bar with his left hand and grabbed the area around the holder with his right hand. Just as he inserted the bar back into the holder, the metal plate fell downward to its resting position. When the plate fell, Employee #1's right hand was still in the area of the holder. Amputation of Employee #1's middle finger and ring finger on his right hand occurred. The pallet's position obstructed the dock leveler's plate and prevented it from locking into place. The accident occurred because an adequate and safe means of moving the dock plate was not provided at the time of the accident and Employee #1 did not have the training and or knowledge to know that what he was attempting to do was unsafe.
